Fork+Band Slingshot Activities and Purchases Waiver of Claims Arising from Inherent Risks, Indemnity and Arbitration Agreement

I, on behalf of myself, my heirs, legal representatives, successors and assigns, (hereinafter “RELEASOR”), in exchange for purchasing or using slingshot sporting equipment, hereby release it, its affiliates, successors, subsidiaries, managers and employees, (hereinafter “RELEASEES”), from any and all injury, damage or death claims resulting from risks inherent in slingshot activities in which I engage. RELEASOR acknowledges that these inherent risks include but are not limited to: equipment failures resulting in injury to person or property, slips and falls and accidents and incidents of all other types. RELEASOR knows that slingshot games and sports are inherently hazardous, and that participants can seriously injure themselves or property as a result of these inherent risks or their own behavior. RELEASOR freely assumes the risk for all injuries, damages or death caused by, or related to the slingshot sports equipment I am purchasing or using. You shall indemnify and hold harmless Fork Plus Band Slingshot from any claims or liabilities arising out of your participation. Any disputes or claims shall be resolved through binding arbitration, conducted by a neutral arbitrator in accordance with the rules of the American Arbitration Association. Each party involved in the dispute shall bear their own costs associated with the arbitration. You acknowledge that this indemnity provision extends to any arbitration awards and their enforcement in any court of competent jurisdiction. Your signature on this waiver indicates your acceptance of these indemnity and arbitration terms. I know that by signing this agreement, I am giving up legal rights, and freely choose to sign this agreement. I have been given adequate time to consider this agreement and to negotiate revisions.

I HAVE READ AND UNDERSTOOD THIS ENTIRE DOCUMENT. I HAVE NOT BEEN FORCED TO SIGN THIS AGREEMENT UNDER DURESS OR TIME CONSTRAINTS. I HAVE BEEN GIVEN AN OPPORTUNITY TO SPEAK WITH A REPRESENTATIVE OF THE RELEASEES TO DISCUSS ANY QUESTIONS THAT I MIGHT HAVE.

BY TYPING MY NAME BELOW, I AFFIRM THAT I HAVE READ, UNDERSTOOD AND AGREE TO ABIDE BY THE TERMS AND CONDITIONS OUTLINED IN THIS AGREEMENT. I ACKNOWLEDGE THAT MY TYPED NAME SERVES AS A VALID AND LEGALLY BINDING SIGNATURE.

I HAVE READ AND I UNDERSTAND THE ABOVE CONTRACT. In consideration of allowing my Child to participate, I consent to the contract and agree that ITS TERMS SHALL LIKEWISE BIND ME, MY CHILD, my heirs, legal representatives, and assignees. I HEREBY RELEASE AND SHALL DEFEND, INDEMNIFY AND HOLD HARMLESS THE RELEASEES LISTED ABOVE FROM EVERY CLAIM AND ANY LIABILITY arising out of risks inherent in this activity. I, likewise, promise not to sue the entities referenced above on my behalf of behalf of my Child. I agree to the indemnity terms set forth above. I further agree to the arbitration terms set forth above. By signing this liability waiver, you acknowledge and grant the business permission to capture photographs or videos of you and children under your guardianship, consenting to their use for marketing and other promotional purposes.
